Currently, my MAJOR concern - The homeowners rights to their backyard landscaping. Especially when they have privately fenced yards. We built our home with Hamlet and the current landscaping was provided by the builder. I understand the purpose of the HOA/BOD in enforcing some rules and I can understand the enforcement only when a homeowner has deliberately neglected their grounds. Such as dead grass, overgrown weeds, trash that is not from the "construction workers" in their lawns. Anything ruled unsightly such as these items I can understand. But I am having a really hard time when my neighbors and my family, get slapped with a warning letter implying that our backyards are not in compliance due to a miscommunication between the HOA and Builder. We did not have a say so when our original landscape was put in and according to our builders, (poor guys..love them) they were laying the yards according to the HOA/BOD's rules. Needless to say, everyone called Hamlet and they quickly acted in defense of the homeowners in trying to resolve the issue. We are still waiting to hear the outcome of those meetings, but IT ABSOLUTELY BOILS MY BLOOD when a HOA/BOD thinks they have the right on what I can and cannot do in my private backyard!! Or the fact that no where was there a "by the way" the homeowners could submit a Variance for Landscaping! I have contacted an Attorney to see what the rights of the homeowners to their own properties and hopefully get something concrete to fight for my rights to my property. After all...WE PAID BIG BUCKS TO move to Daybreak to live in a community where would not feel being run down by an HOA/BOD that is becoming a HOA NAZI! It's MY HOUSE, MY BACKYARD! Today at the last minute I heard of a Garden Affair which apparently homeowners could submit landscape approvals, geeze it would have been nice to know ahead of time. BUT AGAIN WHY SHOULD WE HAVE TO DO THAT!! IT'S OUR PROPERTY! I love my street, love my neighboors but I am so scared and starting to think if it was a bad idea to buy in a HOA run community? Which is why I strongly believe that if you live here and you feel that your concerns are not being heard or you feel that you are living in a socialist HOA/BOD run community...you should quick complaining and do something about it, which is what I plan to do.
