100 year storm...twice in just over a year Print E-mail

   Well here are some pics of the second, yes second, 100 year storm we were hit with last weeked. A lot of Daybreak Homeowners agian had their basements flooding and had to listen to their builder tell them it was a rare 100 year storm that won't happen again any time soon. It's quite apparent there's a combination of severe land drainage issues and irresponsible builders who rushed to build homes in the first phase to take advantage of the real estate boom of the time. Now with the mortgage crisis upon us, new home sales will certainly fall off. Daybreak Apartment Venture #1 Subdivision Print E-mail

Alright here is an update on the development of the apartments the Kennecott Land is going to build in Daybreak. I talked to my friends at the City of South Jordan and found out that Kennecott Land had the area rezoned to a PC zone  before any lots were even sold in Daybreak. And that according to the PC zone code 17.72 (found here: http://www.sjc.utah.gov/municipalcode.asp ) there is basically nothing the Daybreak Homeowners can do about it. The only thing the Daybreak homeowners can do is goto the South Jordan City Council meeting April 8th at 6:30pm and the City Council will be happy to listen to all of your concerns. However in the end as long as Kennecott Land complies with all the regulations per the application process the City of South Jordan has to approve the application, if they don't then Kennecott Land could sue the City of South Jordan. Now if Kennecott Land have any type of public marketing material that said or claimed there wouldn't be any apartments in Daybreak then there are other options, but that would be the only way to prevent this....see attached letter that was sent out by Kennecott Land

UPDATE:
Unfortenately Kennecott Land has instructed (per the contract of the park being given to the City that still gives Kennecott Land the right to sign off on changes) the City of South Jordan NOT to make these changes:
NOT put in concrete for the paths (which is a clear sign that KL does not care about families trying to use the park)
NOT put in BBQ's
NOT put in new play equiopment
NOT put in concrete or asphalt near the tables
NOT to put in more trees
however they will fix the grass..
UPDATE:
It looks like the HOA and KL is denying this (no suprise)....HOA and KL are claiming they asked the City to run the changes throught the DCR process, this is not what the City says, here is what went down...
There was a meeting last week with the City and KL and the City in which the City was voicing their concerns on how KL is not properly building or maintaining the parks and when they are turned over to the City that the City is ending up having to pay for the fixes/changes to the parks that should have been addressed before KL turned them over to the City. And it was in this meeting when KL did in fact remind the City that KL had the right to NOT approve any changes being made to the park (s) that have been turned over to the City, and that they did NOT approve to the changes being made to Hillside park.
However...now it looks as if KL has reached out (so the HOA says) and told the City to submit the changes to the DCR for approval by the BOD (which is KL). So hopefully once the DCR process is done KL will allow the City to make the changes they were planning and trying to make.

It looks like we finally have our swimming pool in Founders Village. Although I doubt this is what Kennecott Land had in mind. I thought some of you would like to see some of these pics.
