There is a recent trend happening in Daybreak, and it is not a good one. More and more Daybreak Homeowners are getting liens placed on their homes and most of the homeowners don’t even know that they have a lien on their home. Now I understand that in order for a lien to be placed on a home the homeowner needs to be notified or served, however in some cases this is not being done. The builders I have personally heard about having issues in Daybreak with liens are Destination Homes, Homes Homes, and Rainey Homes; however there could be other builders who are having issues with their subcontractors as well. Now I am no expert on these type of things or how they work, yet I would encourage all Eastlake Village or North Shore Village homeowner’s reach out to their realtor or their title company to see if they can check to see if there are any liens on their property (to date). I also believe and I could be wrong that there is only a certain timeframe in which a homeowner can petition to get a lien removed from their property. .     Just yesterday I was contacted by a North Shore homeowner (Mr. Morgan) who only found out about the lien on his home when he went to refinance his home recently. And in case this case, there was also a lawsuit filed against a number of Destination Homeowners, none of which were ever properly served per the due process laws of our legal system. Mr. Morgan asked me to post a copy of the lawsuit in hopes that if some of the Daybreak homeowners named in the lawsuit were not aware could be notified via this article by any readers who might know them. If any of the homeowners named in the lawsuit have any questions on how to get the lien removed from their home and how to get their named taken off the lawsuit referenced on the attached document please feel free to contact Mr. Morgan at

South Station Lofts at Daybreak |

The South Jordan Planning Commission approved the South Station Lofts that will be located on the corner of Daybreak Parkway and Lake Run Rd. Apparently there was a 3 to 1 vote with one member of the commission citing safety concerns of residents backing out of their driveways into the alley. I also heard that there were concerns about the architecture of the 4 story, 38 unit structures. While it is prudent to postpone final judgment until the end product is constructed, the renderings of the building are not aesthetically appealing at all. Sure the project is environmentally friendly, but this modern architecture approach in a residential application does not fit in with the surrounding environment at all. . PLEASE visits Daybreak Man’s blog at: http://daybreaktoday.blogspot.com/ which has much more detail and maps, etc… . This article was written by Daybreak Man for his blog, but considering how this is going to effect some current Daybreak Homeowners and the major safety concerns about the project, I thought this needed some more visability. |

CNN just did a write up on this Contemporary Eco-Village in Georgia called Serenbe. It’s actually a really nice looking community and the reason I wanted to share this with everyone this that I think that the founder of the Serenbe Community has really been able to transform their vision of a small “village model†community with a mix of larger homes, high density housing (not anywhere near the scale KL is trying to do), and the neighbor shops. . You can visit the community website here: http://www.serenbecommunity.com/home.html . Take a look at the dog park, perhaps KL and CCMC can take some notes from the Serenbe Community, seems if they have done a great job. |

Daybreak Concrete Problems... |

It has been about 5 years since Daybreak opened and unfortunately about 60+% (my best guess) of Daybreak homeowners are having serious concrete issues.  Some of the issues Daybreak homeowners are running into are, driveways getting dimples (see pics) , stairs cracking and crumbling, severe front or back patio cracks, and the worst is severe cracking of the foundation. Now obviously over time these things are going to happen with concrete, the problem is that most of the issues are arising within two years of the homes being built, which by no means is normal or should be acceptable. However you should know that your first year “bumper to bumper†homeowner warranty might not cover concrete issues and after the first year “bumper to bumper†warranty expires the 2-10 year warranty does not cover concrete issues. And unfortunately many Daybreak Homeowners have found out that even if their first year “bumper to bumper†warranty does cover concrete issues, most Daybreak Builders will not fix any concrete issues and will only give you excuses and delay the problem until their first year “bumper to bumper†warranty expires, and then “PrEsTo!†their off the hook and will no longer even answer your phone calls.                 I have concrete issues and have talked to over at least 3 dozen Daybreak Homeowners personally in the last two year’s who experienced issues as well, with no luck getting their Daybreak builder to do anything about it. So I did some asking around and did some research and found that most homeowners in general who have issues like these have recommended getting the concrete sealed. So was able to locate and contact a Daybreak Homeowner who has a painting company who offers a concrete sealing service.  Attached are some documents that can help educate you on the FAQ about concrete sealing. If you are interested in getting your concrete sealed or you would like to get more information about getting your concrete sealed please feel free to contact: Tyler Bastain 801-637-2792Â
