Big Slide Park coming to Founders Village!!! Print E-mail

   As some of you may or may not know about a year and a half ago I formed a Founders Village Landscaping Committee with the approval of the Daybreak BOD. The FV landscaping committee works and meets with the Daybreak BOD and was tasked with trying to fix/update parks throughout Founders Village. This past year we have been working on getting the park at Oakmond and Lumina (Sunflower Park) upgraded with a whole new look and equipment. After a year and numerous meetings the Daybreak Homeowners who make up the FV Landscaping committee finally agreed with the BOD on the details of the remodel of the park. Now at first the HOA was trying to push the idea of a cookie cutter ~ generic play-set idea on the committee calling it the "best bang for the buck", which we had communicated to them many times we had no interest in since the same sort of equipment which is targeted for younger children only already exists at the Founders Village Splash Pad and that it would NOT be the "best bang for the buck"(see article by Elly on the FV Splash Pad here: http://www.daybreakdaily.com/index.php?option=com_content&view=article&id=245:get-out-and-explore-the-splash-pool-and-founders-park-pavilion&catid=30:the-daybreak-daily&Itemid=58

   And then we bounced the idea of a theme park around a little bit, but the BOD (which is basically Kennecott Land) said they didn’t feel that the theme park idea would fit the visions of Daybreak and reminded the committee that ultimate approval of the proposed park improvements is a BOD not a Kennecott Land issue/decision, even though the park improvement is being paid IN FULL by Daybreak Homeowner funding. And really I don’t have a problem with that since Kennecott Land is the founder of the community as long as the BOD realizes that the Daybreak Homeowners that make up the FV landscaping committee have ALL agreed that the “Big Slide” improvement/upgrade is what we want installed. Now the BOD still has to approve recommendation of the FV Landscaping committee, however considering that the Big Slide improvement is only taking up $30k of the $40k budget we have for the park upgrade and that the BOD (Kennecott Land) already has agreed to the Big Slide idea it is now just a formality for them to approve the plans and move forward with the construction of the Big Slide for Sunflower Park.

North Shore Beach (Toxic Beach) ~ Health Hazards Print E-mail

     The other day I took my family to the North Shore Beach and was SHOCKED at what I saw. Where do I start, first off there was no trash cans or doggie poop bags anywhere near the beach area. The closest trash can bins were a few hundred yards away, and I couldn’t find any doggie poop bags anywhere near the North Shore Beach. The second issue I noticed right away was that there were no restrooms, now I know the permanent restrooms won’t be installed until next year or even the year after that. However if you are going to open a beach to the general public you should have a restroom available.

     Also, and I have heard a lot of complaints about this recently, there were numerous dogs at the beach, all but one were leashed. The dog that was not leashed went to the bathroom in the water, right at the shoreline, not once but twice (and it was not pee either). I might be wrong (and feel free to correct me if I am), but I believe that the dogs are NOT allowed on the beach areas, only the grass areas, I think that is a health department requirement. Now other than the fact that doggie poop that seems to be stockpiling at North Shore Beach is a major health hazard, the problem really is my third concern, there was NO lake security! We were at the beach for almost 4 hours and the lake security rode his bike by once and never even looked at the beach. The lake security stayed on the top path and didn’t even bother to do a ride by the beach area, I have a MAJOR issue with this since the Daybreak homeowners are paying for the lake security and they are doing a horrible job.

     The final issue I found with North Shore Beach was that because there is a lack of trash cans/doggie poop bags & restrooms the beach area is extremely dirty. There is litter everywhere and I also found lots of rusted metal wire on the beach, can you imagine if your child stepped on that, not good.

In the last few years, the demand for off-leash dog parks has increased dramatically nationwide.  Several years ago, a couple Daybreak residents took it upon themselves to solicit Kennecott Land to include this type amenity for our community.  The residents had experience with dog parks, offering their input and expertise.  In addition the residents offered a professionally prepared document compiled by Salt Lake County on the establishment of dog parks (http://www.recreation.slco.org/planning/PDFdocs/SLCo_Dog_Park_Master.pdf).

On May 1st Daybreak officially opened the community dog park.  It is located immediately south of the new temple on 4000 west.  It’s in the drainage area so very difficult to see from the street.  Once you are on the walking path, the entire park is visible.

Before going to the park you must register your dog with the HOA. You will need to provide a health record with current vaccinations, a copy of your dogs South Jordan license, and a check for $15 which off sets key, tag, and maintenance.  In turn you will be issued a key card to access the park and a tag for your dog to wear identifying them as a certified dog park member.  Registration must be renewed annually.

Since moving to Daybreak, I have tried to follow the community rules and be a good Daybreak resident.  It’s not easy as the community rules as printed in our CC&R’s seem to be interpreted by our HOA management on a rather loose per case application. .

A year and a half ago the community instituted a process to submit a complaint for a community issue.  Everyone called it a HOA rat sheet.  No matter what you wanted addressed in the community, you had to submit a “rat sheet”.  The HOA promised that anyone submitting a rat sheet would remain anonymous.  I submitted rat sheets and sure enough, the HOA didn’t keep the complaint confidential and told the homeowner who was responsible for the rat sheet, twice!  Needless to say the HOA’s breech of commitment caused great problems for me. The HOA never addressed the issue of the complaint. .

On to the most recent issue, access to our garage is via an alley.  Our alley is always full of cans for days after garbage collection.  Between the wind and garbage collectors in a hurry, driving through our alley was always a dangerous adventure.  Needless to say, our HOA and the city of South Jordan refused to enforce rules.  So each week, I picked up other residents trash and cans just so we could get to our garage.

Eastlake Village Hamlet Homes Landscaping Issues Print E-mail

   I wanted to shed some light on a recent issue that has become somewhat public, and now very public. A few months ago the HOA office sent out a large number of warning letters to Hamlet Homes owners in Eastlake Village informing them that their backyards were not compliant with the Daybreak CC&R’s and that if their backyards were not brought into compliance with the CC&R’s by May1st they would have to pay fines. Apparently the HOA office has been peeking over fences into Daybreak Homeowners backyards to check to see if they are compliant, which I believe is an invasion of privacy and kind of creepy.

     Now don’t get me wrong, I don’t have an issue with Daybreak Homeowners backyards being reviewed via an appointment with the HOA office to ensure the backyards are in fact complaint with the CC&R’s. I only have a problem with how the HOA is going about ensuring Daybreak Homeowners are in fact in compliance with the CC&R’s. And I also believe that the HOA should get permission from the Daybreak BOD before they send out a large amount of letters like this, considering these backyards were ALL installed by the Hamlet Homes, and the fact there were so many homes affected, you would think that the HOA might have realized this could possibly a builder issue.

     In the recent days since this issue has been brought to light Kennecott land has instructed Hamlet Homes that they need to go back to all the homes affected and update all the backyards in question at their own expense and that all of the updates must be completed by September 2009. So if you are a Hamlet Homes owner in Eastlake Village and have received one of the threatening letters from the Daybreak HOA you can shred it and recycle it and I would suggest contacting Hamlet Homes or the HOA to schedule your backyard restoration.

I should have updated this before (Thanks for the note David), since this article was written, the Dyabreak BOD decided to just approval all the Hamlett Homes effected by this mix up with the HOA and Hameltt. So all in all hopefully this is something that won;t happen again.
