I do understand where you are coming from in regards to you owning your home... however, we have an HOA for the people out there who are not reasonable. There are people who would jump at the oppurtunity to paint their house neon pink with polk-a-dots if they could, leave their yards full of weeds and do ridiculous things to their homes. Yes it is frustrating to those who have reasonable requests but it is to protect those of us from the unreasonable. I think that one of the pp hit the nail on the head... if there is something we're all missing here that is being ridiculous than the HOA should be approached about it. Joe has been great about setting up meetings for this exact purpose and has managed to improve our community as a result.

I guess I am confused. Did you not read the CCR's or the rules and regulations before you signed them? We had to sign them before our builder would even start the contract process on our house.

The process is spelled out pretty clearly regarding improvements, or landscaping. We actually submitted our plan for our backyard before we closed on our house, so it could be done close to move in. What you have to keep in mind, is that not all yards are fenced. There are a number of residents who prefer not to have a fence and appreciate the help from the HOA in keeping neighbors in line. Even if you have a fence, it cuts down on disagreements between neighbors. In my last house, my neighbor would not pitch in any money for our cedar fence because he preferred Chain Link. Seriously. They even threatened to tear it down if it was even a fraction of an inch on their property. Ah, fun times. Needless to say, I am glad I don't have to deal with that here as chain link in not allowed. My yard is fenced, but I appreciate the rules because I don't have to deal with a neighbor whose landscaping may encroach on my property, ie. weeds, overbearing trees, etc.

Not understanding the regulations before you move in isn't really a media gripe or a legal one. However, good luck in getting the builder installed landscaping errors fixed. (I mean that literally, not sarcastically, sometimes that doesn't come through in a post) Daybreak may be controlled, but it has been advertised as such.

The terms "reasonable" and "common sense" are subject to personal interpretation. Some folks feel that their cars are their personal spaces and that rules mandating safety restraints are unreasonable; others see them as reasonable. We moved here knowing that this was a managed community and it was a selling point. We all have choices: either obey the rules and expect no interference or disobey the rules and live with the potential ramifications. Then, one's lawyer can deal with it. With almost 19% of Daybreak owners in default or in arrears in their HOA dues, we all have to live with unsightly neighboring properties, reduced services and spotty management. I'm off to spray my weeds even though some of my neighbors won't.

WOW!! Lucky You!!! Really! OMG! NO we did not actually get the memo from our builder and in fact what your builder did was awesome. Not knowing that a Landscape Variance could be submited would have been nice to know as well. I am glad that you are happy...but guess what not everyone is as I am not only speaking for myself but I am speaking on behalf of 16 homeowners in my street who are pretty frustrated as well. So good for you and thanks for your reply!

I agree with you when It comes to Joe as he has been great and actually inspired me to speak up and as I noted, I am not just speaking or "griping" as people are taking it just for me...I have an entire street of 16+ families who are pretty ticked off. In regards to the funds yes, I can see how HOA delinquency can affect the budget, but the HOA has not been honest and top notch in handling the budget for this community since it started either!

Also one more thing, let's have some sympathy for people who are in arrears. Do you think people like being "black labeled" or like the overwhelming feeling that they might loose their homes? The economy is tough and times are getting harder for people. I find it hard to believe that of that 16% delinquency rate is intentional! As I have heard many of the homes foreclosed and breeding weeds are mostly from investors purchased in Founders Village? If that's not the case, do you think that the homeowner in that situation expected loosing a job or the economy tanking…I do not think so? Moving & building a home in Daybreak was not cheap, especially 2 yrs ago when it was in its peak pricing? If you have a neighbor who you know is struggling and their yard looks like “weeds” from a horror movie, have you offered to help or out of kindness… mow their yard or assist with maintaining weed control? People are depressed and worried, let alone think about weeds? How would know if you don’t ask your neighbor or better yet surprise them by helping out? That would certainly lift their spirit and yours as well? Not to gripe, but I guess we are lucky in my street, where we have pitched in with helping neighbors who are struggling and the rewards are beautiful. Unfortunately, the HOA does not help out in situation like these because there is a discrepancy within CCMC and the HOA which is the same? There are scenarios of people who where struggling and called CCMC directly, got assistance with delinquency and placed on Monthly Plans and are current. But then the HOA continues to keep their accounts frozen prohibiting them from using the amenities because they are paying monthly instead of quarterly? So much for making that person feel that the HOA is there to help…just another way of making people feel like crap and that the HOA RULES!! Hah…hah…ha! Like I said, I am speaking these frustrations from a meeting held with my neighbors who want positive change. So, we will look forward to the next HOA/BOD meeting as usual, speak our minds hoping that they are listening and be let down…over and over. As my point today when I had conversations with Jeff Stephenson with the BOD/Kennecott...in regards to the Hamlet situation and was left with the "brushed off" feeling and never responded to… BY THE WAY JEFF THANKS! GREAT SPORT! I REALLY DID NOT EXPECT YOU TO RETURN MY CALL!
